Miami Condo Buyers File Class Action Lawsuit

Condo buyers in Miami, FL have filed a class action lawsuit against developer Kenneth Baboun and his company BBB Group saying he committed fraud and breach of contract. Baboun cancelled the planned project to build condos at 1390 Brickell Bay condominium tower due to hurricane delays and other issues.

The problem is the potential residents say that Baboun claimed to have broken ground which meant that they needed to pay their second deposit. Once they did he cancelled the project citing those delays.

They want their money back with interest. However it’s not just the full deposit but they also want the value of the condos if they had been built. I do think that’s a little greedy. Let them give you back the money you gave them, you want interest fine, but to get the full price of a condo you didn’t pay for? Bull.

My Family Experience With Lawsuits

A few years ago maybe more than 14 years, my uncle was in a car accident. With him was my cousin and his daughter around 10 at the time and she was badly injured. One of the worst injuries being a huge wound in her forehead.

The accident was the fault of the other driver, who had run a red light when he crashed into them. There was a lawsuit which my uncle won. He didn’t want to take anyone to the cleaners or take all they have had. That is not how my family thinks or operates.

He only wanted payment for his daughters medical expenses then and in the future. He recieved a payment, somewhere around $100,000. To this day my grandmother his mother still rants at lawyers, because when they were done, he wasn’t even left with half of that money to pay for his child’s medical care.

I know not all lawyers are bad people, but unless I am really pushed for it to fight for a cause, lawsuits and lawyers are something I hope to never have to deal with.

Bausch & Lomb Fungus Lawsuit

Jacqueline Wartmann, 57, is suing Bausch & Lomb because of an eye fungus that she says scarred her cornea after she used their contact solution.

The lawsuit follows a similar one that was filed in New York. Health officials have said that there are over 109 cases that have been confirmed so far. More than 50 of these are in Florida alone.

Why is it always Florida? Until I moved here from New York I never realized how much I hear about Florida in the news everyday and I’m talking the national news such as CNN. I made a quick trip to the bathroom to check the medicine cabinet and sure enough the solution I use for my contacts? Bausch & Lomb.

I have bad eyes but they have always been that way. They are no better or worse since I have gotten contacts. So what should I do now? Sue because I happen to own the same product used by those in the lawsuit? Why, when nothing is wrong with me? Roughly any product costs twice what it is supposed to because of ridiculous lawsuits from greedy people day in and day out. Case in point; Mrs. I found a finger in my Wendy’s Chili. Now your going to jail and the world knows your a liar willing to do anything for a buck. Good job.

Class Action Watchers

I wonder if the people who sit and wait until they can happyily sue for millions are even aware of what they are? Greedy and ridiculous. Everytime I turn on the news I see another lawsuit is on the way usually for no good reason.

For instance I see that people who owned Teflon non-stick pots and pans in 15 states are suing because they say Dupont didn’t disclose possible health risks. I say the only people who should even consider suing is someone who was injured by the chemicals.

And it doesn’t seem like anyone is. They just watched the news and saw all of the reports that there MIGHT be something wrong and decided to sue. How is it different than those people suing fast food companies because they are overweight. I’m sorry but I am overweight and I would never blame anyone else. I put the food in my mouth no one forced me to.

I firmly believe that there are thousands of people who sit and wait to see who they can take advantage of next.

Big Tobacco Blowing Smoke

In 1998 a few states including California and New York sued and settled with tobacco companies for a sum of $206 billion. The money was to be put toward health care for the ailing health of smokers.

However as of 2006 the tobacco companies have yet to pay and Calfornia has sued to recieve their money. The cigarette producers say that they don’t owe them any money because the agreement signed says they don’t have to pay if their stocks fell, and their stocks did fall.

California Atty. Gen. Bill Lockyer filed the lawsuit to keep the companies from taking back more than $154 million that they owe that state. New York has also said that they would sue to get their share that is owed to them.

You Can’t Make This Stuff Up

I came across a hilarious website that lists hundreds of absurd lawsuits from around the world. I thought I would share some of them and you can check out the website. The site is called Power of Attorney and if you look beyond the stupid lawsuit stories you will notice a theme, the people who are dumb enough to sue for really stupid reason, don’t get half of the money that their lawyers get. Here are some that are just completely stupid.

These are just a few of the stupid lawsuits and they get even dumber as you go along. I could literally spend all day reading them. Have fun.

Parents File Benzene Class Action Lawsuit

Earlier this week it was reported that some soda’s may have higher levels of benzene, a carcinogen, than was found in water. The parents want the manufacturer to stop selling the soda’s which they believe are marketed towards children due to the fact that they are usually found in an action figure shaped bottle.

The two soda’s are Polar Diet Orange Dry and Bellywasher. The plaintiff’s say that they should be pulled immediately but the FDA says that the drinks are ok for human consumption.

 

$2 Billion AOL Settlement

A judge recently approved a $2.65 billion class-action settlement for AOL. Shareholders had “complained that AOL improperly accounted for dozens of advertising transactions, inflating revenue for 15 quarters between 1998 and 2002″ — prior to the AOL/Time Warner merger.

According to the deal approved by [Judge] Kram, Time Warner will pay the bulk of the settlement while its auditor, Ernst & Young LLP, will pay $100 million.

The judge noted that “”the settlement had received overwhelming support by nearly all of the estimated 600,000 claimants,” but that, despite the support, class members would “not recover their entire loss.”

Vioxx Plaintiff Gets $13.5 Million

…but, of course, Merck plans to appeal.

The 77-year-old man, who blamed his heart attack on Merck’s Vioxx, won $9 million today after already being awarded $4.5 million, bringing his grand total to $13.5 million.

This was the 6th trial over Vioxx, and “the first involving people alleging use of 18 months or more.” That 18-month benchmark is significant because “the study that prompted Merck to voluntarily withdraw the drug found that its risks doubled after 18 months’ use.”

In its only other loss in a Vioxx case, Merck was ordered last August to pay $253 million to the widow of a man who died after taking the drug for a short time.

Merck is gong to face almost 10,000 more cases in state and federal courts, and the company “has vowed to try them one at a time.” That’s gotta be one happy (and rich) team of lawyers…

Students Sue Over SAT Errors

The SAT’s which took place October 2005 had problems when it came to the scoring. Thousands of students were given scores that were to low sometimes as much as 450 points and some to high as much as 50.

The policy of the College Board is to fix the scores that were incorrectly too low, but the ones that are too high will stay the same. That has angered students who feel it is unfair for them since they will have to compete for admission, scholarships and financial aid with students who have an inflated SAT score.

The lawsuit has two sides: Students who recieved the wrong score and students who are angry that their classmates get to keep their falsely inflated scores. The lawsuit is being handled by three Minnesota firms; Larson King, and Zimmerman Reed and McSweeney & Fay. The SAT errors affected 4,411 out of 500,000 students.
