Wrongful Death Lawsuit

A family of a man that was accidentally killed in a grocery store is now suing the store owners and employees. The man came in and tried to rob the store and while fending him off the robber was killed.

His family says that store employees used too much force.

If the employees had viciously beat him to death then I could argue the parents point but they tried to restrain someone who had come to rob them and then the man became aggressive. If he had killed one of the employees what would they have said then?
